Our Expertise
Has your VA claim recently been denied or paid at a rate less than you deserve? Perhaps you have been represented by service organizations such as the American Legion and others. They are fine organizations and are well qualified to aid in the preparation and submission of your claim.
However, they do not have the experience or knowledge I have in representing veterans once that initial claim has been denied or inadequately decided.
Using baseball terminology, I would be referred to as the "closer". The person, who once the starting pitcher has done his best. enters the game charged with bringing the game to a successful conclusion.
With over 40 years experience with claims such as yours you are assured of receiving the best possible representation and presentation of your notice of disagreement and appeal to the VA decision makers. I will put my knowledge of VA law and procedures gained in over 40 years of employment with the VA to work on your behalf.
INITIAL REVIEW
Once you appoint me as your Representative, I immediately access your records and review present and past claims and any decisions the VA has made.
I look for mistakes made by the VA (clear and unmistakable errors (CUE)) which resulted in an erroneous denial of benefits. I also look for any instance where the VA decision maker has "cut corners" and not provided you the benefit of reasonable doubt in your favor.
I will provide you an assessment of my findings and recommendations within 5 days of being appointed your representative. With rare exception, you will not need to respond to any VA request or notice, as I will do that for you. I will provide copies of all correspondence I submit to the VA on your behalf. I will explain what is transpiring in terms you can understand without relying on VA jargon.
RECOMMENDATION(S)
Following the preliminary review we will provide you with a list of recommendations which, when followed, will have the best chance of resulting in a favorable decision from the VA.
IN ALL INSTANCES
PURSUNG YOUR CLAIM
I will file any needed claim augmentation paperwork with the VA, monitor to ensure its receipt and follow up with the VA on your behalf to ensure they are completing your claim in a timely manner.
I ensure action is taken on your claim in as timely of manner as possible and will review any decision made by the VA ensuring they committed no errors in processing it or failed to request and consider relevant evidence prior to making their decision.
Unlike many other representatives, I serve as more than a "pass through" between you and the VA. I don't simply submit your application and wait for the VA to make a decision but rather I continue to act as your representative and check to make sure the VA is doing what they are supposed to and are giving you the service you deserve!
Once that decision is made, I double check everything and make sure the VA decision is correct.
I will represent you as your authorized agent before the VA at every step of the way. looking over their shoulder to make sure they are doing what the law calls for in the processing VA claims.
POST DECISION
If your claim has been denied by the VA, I will advise you how best to proceed.
If your claim is forwarded to the BVA for their independent review, I will provide a written argument citing VA law and regulations that, when interpreted correctly, are in favor of awarding the benefit(s) sought. .
In other words, I am with you all the way.
You will be treated with dignity and respect.
You will be kept informed of action I take on your behalf. In most cases, we will advise you of VA action before you get the official notification letter form the VA.
I monitor your claim on a daily basis to ensure it doesn't "fall through the cracks."
I will provide the best representation possible!
